The information on this website is not legal advice

The content of this website is provided for general information only. It is not legal advice and must not be relied upon as such. Legal advice depends on the particular facts of each matter and on the law in force at the time it is given. You should obtain specific professional advice before taking, or refraining from taking, any action on the basis of anything on this website.

Using this website does not make you our client

No advocate–client relationship arises between you and OK Law by reason of your use of this website, your submission of an enquiry through it, or your receipt of any material from it. We act for a client only once we have completed our conflict and identification checks and the client has accepted our letter of engagement.

Until we are formally engaged, please do not send us information that is confidential or time-sensitive. Information sent to us before we are engaged is not protected by advocate–client privilege, and we may already act for another party whose interests are adverse to yours.

This website is intended to provide information about OK Law and the areas in which we practise. It is not an advertisement, a solicitation of work, or an inducement to instruct us, and nothing on it should be read as a promise or guarantee about the outcome of any matter. To the extent that any part of this website is found to be inconsistent with the Advocates Act (Cap. 16) or the rules made under it, that part is to be disregarded.

We take reasonable care to ensure that the information on this website is accurate when it is published. The law changes, however, and we do not undertake to update the website. We make no representation or warranty, express or implied, that the content of this website is accurate, complete or current.

Where you send us an enquiry through this website or by email, you consent to our responding by email. Email is not a secure medium: messages may be delayed, intercepted, corrupted or lost, and we do not accept liability for that. We will handle any enquiry in accordance with our Privacy Policy.

Limitation of liability

To the fullest extent permitted by law, OK Law and its partners, employees and agents shall not be liable for any loss or damage, whether direct, indirect or consequential, arising out of or in connection with your use of, or inability to use, this website, or your reliance on anything contained in it. This includes loss of profit, loss of business, loss of data and loss of goodwill.

Privacy and cookies

Our Privacy Policy explains how we collect and use personal information through this website, and how we use cookies. It forms part of these Terms.

Changes to these Terms

We may revise these Terms at any time by amending this page. The version published here is the current version and applies to your use of the website from the date on which it is published. Please check this page from time to time.

Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or with your use of the website, are governed by the laws of Kenya.

Before any arbitration is commenced, the party raising the dispute shall lodge a written notice of dispute with the other party, setting out the nature of the dispute and the relief sought. Where that party is you, the notice shall be lodged with us at legal@oklawllp.com or at our offices set out under Contact us below. No arbitration may be commenced until at least ninety (90) days have elapsed from the date on which the notice of dispute is lodged.

During that period of ninety (90) days, the parties shall attempt in good faith to resolve the dispute by negotiation.

If the dispute is not resolved within that period, it shall be referred to and finally determined by arbitration before a sole arbitrator in accordance with the Arbitration Act, 1995 (Cap. 49). The arbitrator shall be appointed by the President for the time being of the Law Society of Kenya, and shall be an Advocate of the High Court of Kenya of not less than fifteen (15) years’ post-admission experience. The seat of the arbitration shall be Nairobi, Kenya, and the language of the arbitration shall be English. The award of the arbitrator shall be final and binding upon the parties.

Notwithstanding the foregoing, either party shall be at liberty to apply to the High Court of Kenya for an interim measure of protection at any time, including during the ninety (90) day period and at any time pending the constitution of the arbitral tribunal. In accordance with section 7 of the Arbitration Act, 1995 (Cap. 49), such an application is not incompatible with this agreement to arbitrate and shall not be treated as a waiver of it. The High Court of Kenya shall further have jurisdiction in aid of the arbitration and for the recognition and enforcement of any award.
