Landmark surrogacy and birth registration judgment
Successfully representing parents who had undergone an in vitro fertilization (IVF) process and surrogacy in an application against the Attorney General (AG) to procure a birth certificate for the minor, registered in the biological parents’ names as opposed to that of the surrogate. Successfully challenging the AG’s argument that the biological parents needed to undergo an adoption process to procure the birth certificate in their names; obtaining a landmark Judgment that was precedent-setting in light of the non-existence of surrogacy legislation in Kenya.
